North Sacramento Free Tool Library

• I am capable and experienced in using the tools I am borrowing, and I will use the tools I am borrowing in a proper manner.
• I waive any and all claims against Sierra Service Project and SSP's North Sacramento Free Tool Library (Tool Library), its officers, agents, and employees for any injury or injuries of any nature that I may suffer or incur in the use of the tools that I am borrowing from SSP's Tool Library.
  
• I agree to release and indemnify and hold harmless Sierra Service Project and SSP's Tool Library, its officers, agents, and employees from any and all liability, loss, claims, and demands, actions or causes of action for the death or injury to any persons and for any property damage suffered or incurred by any person which arises or may arise or be occasioned in any way from the use of tools I am borrowing from the SSP's Tool Library. I am aware that Sierra Service Project, SSP’s Tool Library, its partners, directors, officers, members, volunteers, and employees claim no expertise and make no representation concerning the fitness of any tool for any particular use.
• I affirm my information is current, true, and correct and may be subject to verification. I further state that I have read and fully understand the rules and regulations in the SSP's North Sacramento Free Tool Library Borrower’s Agreement & Tool Use Policy and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me. I have read this Waiver and Indemnification form, relinquishing any and all claims against SSP, SSP's North Sacramento Free Tool Library, its officers, agents, and employees.

1. Members must be age 18 or over to borrow tools from SSP's Tool Library (“Library”).

2. Prior to borrowing tools, all Members must create an online account and complete and sign a Waiver and Indemnification form in addition to this agreement.

3. At the first tool pick up, and once a year after to renew your membership, a Library volunteer or member of the staff will verify your residence by reviewing a valid government-issued photo ID.

4. Library volunteers or staff are available to assist in explaining the operation of tools. However, by taking possession of any item, the Member is certifying that they are capable of using that item in a safe and proper manner.

5. Only the Member is authorized to use Library tools. The Member shall not permit the use of items checked out by them by any other person unless by the express written permission of the Library.

6. Members will not be charged for borrowing any tool, but will be invited to make a suggested $25 annual donation to support the project as a Friend of the Tool Library.

7. Each tool’s loan period is one week, and can be renewed once. Tools are primarily reserved online in advance with an appointment for pick up within our open hours, Tuesdays 4 to 6 pm and Saturdays 10 am to 12 pm, at Sierra Service Project’s office at 1516 Del Paso Blvd, Sacramento, CA 95815. Walk-ins are welcome, but we cannot guarantee tool availability.

8. All tools borrowed are to be returned in-person directly to a Tool Library volunteer or staff on their due date. Tools may only be returned during the Library’s open hours, which are Tuesdays 4 to 6 pm and Saturdays 10 am to 12 pm at Sierra Service Project’s office at 1516 Del Paso Blvd, Sacramento, CA 95815. No appointment needed to return tools.

9. If a tool is overdue, the Member will be responsible for a $1 per day late fee until the tool is returned. Late fees are capped at the full replacement cost of the tool plus a $5 administrative fee per tool. The Library may replace severely delinquent tools, holding the Member responsible for the full replacement cost plus a $5 administrative fee. Fines must be paid in full before borrowing additional items.

10. The Library reserves the right to use appropriate steps to retrieve delinquent tools or unpaid fines and fees, including the use of a collection agency and/or legal action and assess the delinquent Member with the cost of any such action. The Library also may forgive fees due to special circumstances.

11. The Library reserves the right to refuse the loan of any item to any individual at its discretion.

12. The Member agrees that the Library is not responsible for any manufacturing defects in quality of workmanship or materials inherent in any borrowed tools.

13. The Member agrees that if any borrowed tool becomes unsafe or in a state of disrepair, they must immediately discontinue use of the tool and notify the Library of the issue on return, if not earlier.

14. All tools are to be returned in the same (or better) condition as they were issued, barring normal wear and tear. All tools must be returned clean. The Member agrees to pay for the loss of or damage to any item and further agrees to accept the Library’s assessment of condition of items and to further agree to the Library’s assessment of fair restitution for damage, dirtiness, delinquency, and/or loss of items in part or in total. This restitution amount could equal the full replacement cost of the item plus a $5 administrative fee.

15. I affirm that the information that I have provided is current, true, and correct. I understand that this information may be subject to verification.

16. I further state that I have read and fully understand the rules and regulations of SSP's Tool Library, and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me. I relinquish any and all claims against SSP and SSP's North Sacramento Free Tool Library.
